Abstract: One of the ethos of the earlier age when litigation was regarded as evil was discouragement to recourse the law. Then it was unheard of that neighbours would sue neighbours (for instance for nuisance,) that friends would sue friends (for instance for breach of contract,) or that siblings would sue siblings (for instance for inheritance). Then justice was administered without formality. Today access to justice is regarded as a fundamental human right which ought to be readily available to all.
